Is The Insurance Company’s Offer Really Fair?
One of the most frequent questions we receive is how much a case is worth.
While this is a difficult question to answer, we can provide some general guidelines as to what workers’ compensation benefits may be available.
Generally, injured workers who receive temporary total disability are eligible to receive two-thirds of their weekly paycheck. However, once an injured worker reaches a point of maximum medical improvement (meaning the injured worker is not going to get much nor worse), insurance companies and the injured employee can agree to settle the entire claim for a lump sum. This halts weekly benefits.
In some cases, it may be fair for the employee, who needs money right away. Too often, however, employees who are unrepresented settle for less than they are entitled to because they are unaware of their rights or fail to account for the full amount to which they are entitled.

When filing a workers’ compensation claim, the insurer may offer a lump-sum settlement to resolve your entire claim.
This can be tempting, particularly if you are seriously injured and the offer involves a significant amount of money. But accepting such an offer must be done carefully, with a full awareness of your rights, legal options and the full and fair compensation to which you are entitled.
